Statutory Protections for Victims of Online Gender Violence

Data Protection Act (2019) – Protection Against Doxxing

Section 72 makes it illegal to publish personal identifiable information (such as phone numbers, home location, or personal identification) without explicit consent. Violators face fines up to KES 3 Million or custodial sentences.

Computer Misuse & Cybercrimes Act (2018) – Cyber-stalking & Harassment

Section 27 explicitly penalizes cyber-stalking, targeted online harassment, non-consensual distribution of intimate media, and sending extortionate messages using digital systems.

What to do if your private information is leaked online:

  1. Do not engage: Do not reply to or interact with posts leaking your information.
  2. Document immediately: Take full-screen screenshots displaying the URL, date, time, and user handle.
  3. Report to platform host: Submit violation reports under "Harassment / Personal Information Exposure."
  4. Escalate to Data Regulator: File an official breach complaint directly with the Office of the Data Protection Commissioner (ODPC).

What to do if intimate media is shared or threatened:

  1. Create a Digital Fingerprint: Use StopNCII.org (ages 18+) or TakeItDown (under 18) to hash media locally on your device without uploading original files.
  2. Do not delete files: Keep original image metadata stored safely on an external storage drive for law enforcement.
  3. Notify platform trust teams: Use direct escalation links provided in our Legal Directory below.

What to do if you suspect account monitoring or stalkerware:

  1. Do not immediately delete suspicious apps: Deleting stalkerware can alert the perpetrator that you noticed.
  2. Use an uncompromised secondary device: Access emergency help and safety planning from a secure friend's device.
  3. Check location sharing: Audit Google Maps location sharing, Apple Find My, and social media geotags.

What to do if someone demands money or favors:

  1. Do not pay or send more images: Payment does not stop extortion; it usually causes escalated demands.
  2. Lock down communication: Restrict messaging options to direct contacts only.
  3. Report to Cybercrime Unit: File a formal report under Section 27 of the CMCA at the nearest police station.
